Did You Know? New Homes in NZ Come with Automatic Warranties

Many buyers think a builder’s warranty only applies if it is written into the contract, but that is not always the case. In New Zealand, newly built homes come with automatic legal protections under the Building Act, even if they are not specifically mentioned in the agreement. These are known as implied warranties.

For new builds, there is a 10-year implied warranty covering important structural matters such as foundations, walls, roofing, and overall workmanship. There is also a 12-month defect repair period, which can cover common issues such as sticking doors, jammed windows, minor floor cracks, or other defects that may appear after completion.

These protections are provided by law, and the builder cannot simply contract out of them.

One important thing buyers often misunderstand is when the warranty period starts. Many people assume it begins on settlement day, but it usually starts from the date the building work was completed, often linked to when the CCC, or Code Compliance Certificate, was issued. This means if the property was completed months before you settle, part of the warranty period may have already passed.

A useful tip from the Harcourts Candice Team is to always ask when the CCC was issued for the property. Knowing the CCC date helps you understand how much warranty protection may still remain and whether the builder may still be responsible for fixing certain issues.

When you buy a new build with us, we help check key details such as the CCC issue date, the builder’s reputation, and what warranties may still apply. This helps make sure you do not miss out on protections you may be entitled to.

Not sure how much warranty is left on a new home you are considering? Worried the protection may expire soon after settlement? Let the Candice Team help you double-check before you commit, so you can move in with confidence and peace of mind.
